Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BScheduler appointment-scheduling platform and related websites and applications (the “Service”), operated by BSCANNED Inc. (“BScheduler,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least the age of majority in your jurisdiction, or have authority to bind the business you represent.

Use of the Service

Businesses use the Service to manage bookings, staff, services, and payments. Clients use it to book and manage appointments. You agree to use the Service only for lawful purposes and in compliance with these Terms and applicable law.

Bookings, deposits, and payments

Appointment availability, pricing, deposit requirements, and cancellation rules are set by each business, not by BScheduler. When a deposit or payment is required, it is processed through Stripe and flows to the business's connected account. BScheduler is not a party to the service relationship between a business and its clients and is not responsible for the services a business provides. Refunds and cancellations are handled according to the business's policies.

Acceptable use

• Do not misuse, disrupt, or attempt to gain unauthorized access to the Service.
• Do not upload unlawful, infringing, or harmful content.
• Do not use the Service to send spam or unsolicited messages.
• Do not reverse engineer or resell the Service except as permitted by law.

Notifications

The Service sends transactional emails and text messages (such as confirmations and reminders) related to your bookings. Message and data rates may apply. You can manage or opt out of certain communications where supported.

Intellectual property

The Service, including its software, design, and content, is owned by BSCANNED Inc. and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Content you submit remains yours; you grant us the rights needed to operate the Service.

Third-party services

The Service integrates with third parties such as Google, Stripe, Twilio, and Resend. Your use of those services may be subject to their own terms and privacy policies.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, BSCANNED Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.

Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
